This matter involved the refurbishment of a 1960s mixed-use retail, residential and cinema development with basement car parking in central London. Various issues including ponding and water ingress were affecting the development.
The building owner initiated a claim against the developer and the design and build contractor, and engaged WJM&P as architectural experts to advise on the cause of ponding and leaks, the likely scope of remedial works required, and the roles of the various parties involved. We carried out detailed surveys of the leaks and inspections on site to analyse the adequacy of the construction and the pattern of the leaks. We also commissioned laboratory tests and engaged specialist drainage consultants to analyse the siphonic drainage system.
We prepared advice on the appropriate remedial works and commented on a programme of works by others. We conducted extensive reviews of industry guidance, archive documents, witness statements and other evidence and prepared an expert report for exchange. We attended experts’ meetings as part of a mediation.
The matter was settled in negotiations following the mediation.
